Laser pointer/laser laws?

I was wondering about the laws for the U.S.A. specifically for New Jersey. Am I allowed to purchase a laser pointer that is 100mW or does it have to be sold as a laser. And am i allowed to purchase a laser of 100mW in New Jersey or this against the law?

You are not allowed to purcase a 100mW laser pointer in the US no matter whether it is sold as a laser or laser pointer IF it does not have an accession number.

The laws for lasers in the US are controlled by the Food & Drug Administration (FDA). These laws are confusing, ambiguous and in need of updating. The FDA is in the process of reviewing portable laser laws.

In the mean time the current laws are that it is illegal to buy/sell or trade portable pointers over 5mW that do not have approval and an accession number. Owning and using portable lasers with more than 5mW lasers is legal.

Most states do not have laws for portable lasers but you will need to check with legislators in New Jersey to be sure.
